Retrospectiva do julgamento de Sam Bankman-Fried em outubro-novembro de 2023 e as implicações para criminal accountability em cripto fraud cases.

Recap: o que aconteceu na FTX

FTX era second-largest crypto exchange globally em 2022 (volume), fundada por Sam Bankman-Fried (SBF) em 2019. Alameda Research era trading firm separada operationally mas com same ownership (SBF, Gary Wang, Caroline Ellison) e physical headquarters compartilhadas em Bahamas.

Em novembro 2022, CoinDesk leaked Alameda balance sheet showing $14,6 billion em assets predominantly em FTT (FTX's own token) — highly speculative. CZ (Binance) announced sale of his FTT holdings. Bank run on FTX ensued. Em 11 novembro 2022, FTX filed Chapter 11.

Forensic accounting subsequently revealed: FTX customer deposits commingled with Alameda trading capital. Customer funds used by Alameda for proprietary trading e personal expenses of leadership. Estimated $8+ billion in customer funds misappropriated.

Arrest e extradition

12 dezembro 2022: SBF arrested em Bahamas at request of US authorities (DOJ).

21 dezembro 2022: SBF extradited to US after waiving extradition rights. Held em federal custody.

Initial release on $250M bail bond — released to parents' home em Stanford, California. Bail revoked August 2023 após findings of witness tampering (SBF allegedly tried to influence cooperating witness Caroline Ellison via Signal messages). Returned to Metropolitan Detention Center Brooklyn for remainder of pre-trial period.

Trial October-November 2023

Trial began em 3 outubro 2023 em Southern District of New York (SDNY), Judge Lewis Kaplan presiding.

Charges: 7 counts em initial indictment — wire fraud, conspiracy to commit wire fraud, securities fraud, commodities fraud, money laundering. (Additional 5 charges to be tried em separate later trial, eventually dismissed em deal post-conviction).

Key witnesses: Caroline Ellison (former Alameda CEO, ex-girlfriend), Gary Wang (FTX co-founder, technical lead), Nishad Singh (FTX engineering director). All pled guilty separately and cooperated.

SBF himself testified em own defense — unusual decision. Cross-examination by AUSAs Danielle Sassoon e Nick Roos was devastating. Memory failures e contradictions exposed.

Em 2 novembro 2023, after 4 hours of deliberation, jury convicted on all 7 counts.

Sentencing March 2024

Em 28 março 2024, SBF sentenced. Judge Kaplan imposed 25 years federal prison + $11 billion forfeiture order.

Sentence calculations: federal guidelines suggested life or near-life (40-50 years). 25 years represented downward departure citing age (32 at time), absence of prior criminal history, e some cooperation post-conviction.

Concurrent vs consecutive: 7 counts ran concurrently. Even cumulative max would not have meaningfully changed outcome given concurrent structure.

Co-conspirators sentencing

Caroline Ellison (former Alameda CEO): sentenced setembro 2024 to 2 years prison + $11B forfeiture (joint and several with SBF). Substantial cooperation noted. Self-surrendered, served at low-security facility em Connecticut.

Nishad Singh: sentenced outubro 2024 to time served + 3 years probation + community service. Most cooperative; no prison time.

Gary Wang: sentenced fevereiro 2025 to time served + 3 years probation + community service. Similar profile to Singh.

Ryan Salame (FTX Director of Operations): sentenced 7,5 years em maio 2024. Less cooperative than other co-conspirators.

FTX bankruptcy recovery

John J. Ray III, veteran bankruptcy attorney (also handled Enron), appointed as FTX CEO em chapter 11 process.

Recovery progresso: dramatic. Initially estimated maybe 30-40% recovery. By 2024, multiple cripto assets recovered (Solana, BTC) had appreciated dramatically. Final settlement em 2025 paid:

(1) Customers 100% em USD terms (based on November 2022 valuations).

(2) Plus interest 9% annually on those USD valuations.

However, customers who 'wanted to remain long cripto' faced significant opportunity loss — receive November 2022 USD valuation for assets that subsequently 3-5x'd.

Industry e regulatory impact

Regulatory clarity em US accelerated post-FTX. SEC and CFTC enforcement actions against various exchanges intensified. Coinbase resisted SEC charges with apparent success em 2024-2025. Other exchanges (Bittrex, Bitstamp US) reached settlements.

Proof of Reserves emerged como industry standard 2023-2026. Following FTX collapse, virtually every major exchange (Binance, Coinbase, Kraken, OFFCODE) began publishing Merkle-tree-based Proof of Reserves regularly.

Stablecoins: US Stablecoin Bill (GENIUS Act, 2024) codifies stablecoin requirements directly traceable to lessons from FTX/Tether questioned reserves.

Founder accountability normalized. SBF (25 years), Do Kwon (22 years), Alex Mashinsky/Celsius (sentence pending 2026) all received substantial prison sentences. Industry stigma against fraud strengthened.

Lições enduring

Lição 1: exchange custody is concentrated risk. FTX taught market that 'not your keys, not your coins' applies even to flagship US-facing exchanges with US$ billions em trust. Self-custody for significant holdings remains essential.

Lição 2: brand reputation is no substitute for transparency. FTX had blue-chip VC investors (Sequoia, Lightspeed, Tiger Global), celebrity endorsements (Tom Brady, Gisele Bündchen), naming rights on stadiums. None of that prevented or surfaced the fraud.

Lição 3: Proof of Reserves is necessary but not sufficient. PoR shows assets exist at point in time. Doesn't prevent commingling of customer funds with proprietary capital during the interval. Combination with independent audits + segregation requirements is the gold standard.

Para o usuário OFFCODE: Proof of Reserves mensal + AWS KMS custody com segregation. Operational design specifically intended to make FTX-style commingling impossible. But no system is 100% safe — diversify between exchanges and use self-custody for long-term holdings.

Aviso YMYL: FTX collapse cost users $8 billion. Industry took years to recover. The risk of single-platform failure is real e ongoing. Treat any centralized exchange como counterparty bearing risk.
