Background: a relação Bitfinex-Tether
Bitfinex é exchange fundada em 2012 em Hong Kong. Tether foi fundada em 2014 e mantém shared ownership e leadership com Bitfinex — both operadas por iFinex Inc, ultimately controlled by Giancarlo Devasini (Bitfinex CFO) e others.
Por anos, Tether claimed que USDT was 100% backed by US dollar reserves held by Tether Limited. Public skepticism existed due to lack of audit (Tether never produced full audit, only attestations).
A investigação NYAG (2018-2019)
Em 2018, New York Attorney General office (NYAG) initiated investigation into Bitfinex e Tether. Initial focus: whether Tether was properly backed por USD reserves.
Em 2019, NYAG filed action revealing that em 2017, Bitfinex had lost access to $850 million held by payment processor Crypto Capital Corp (Panama-based, subsequently linked to fraud). To cover the hole, Bitfinex borrowed $625M from Tether's reserves (effectively reducing USDT backing) e a credit line of $200M.
Em essence: USDT reserves were NOT fully backed por USD at the time. Bitfinex e Tether disclosed this to NYAG but had not disclosed publicly.
Settlement em fevereiro 2021
Em fevereiro 2021, NYAG announced settlement. Terms:
(1) Bitfinex e Tether banned from operating em New York state.
(2) $18,5M settlement payment to NYAG.
(3) Tether required to provide quarterly reports on reserve composition for 2 years.
(4) No admission of wrongdoing.
Crucially, settlement did NOT include criminal charges. NYAG attributed lack of criminal action to limitations of civil enforcement authority e cooperation during investigation.
Reserve composition post-settlement
Tether published first detailed reserve breakdown em May 2021. Findings shocked many:
(1) Only ~3% em direct cash. 65% em commercial paper (short-term unsecured corporate debt). 24% em loans to other entities, secured cripto loans, e other assets. Remainder em bonds, gold, etc.
(2) Significant gap from 'fully backed by USD em a bank account' marketing prior.
Subsequent quarters: Tether progressively shifted reserves to safer assets. By Q4 2022, commercial paper fully eliminated. By 2024, majority em US Treasury bills (short-term direct US gov debt).
DOJ investigation 2023-2025
Em outubro 2021, Bloomberg reported US DOJ investigation criminal de Tether executives for bank fraud (allegedly misrepresenting business to banks to open accounts). NYAG was civil; DOJ criminal would be much higher stakes.
Em maio 2026, status of DOJ investigation: unclear publicly. No charges filed against Tether or any executive. Tether continues to operate normally.
Whether DOJ closed investigation or continues active is not publicly known. Tether's continued operation without legal disruption suggests either case is dormant or being resolved.
Attestation evolution
Tether's attestations evolved over time:
Pre-2018: vague claims of USD backing, no third-party verification.
2018-2019: friedman LLP attestations — limited scope, criticism that they did not constitute full audit.
2019-2022: Moore Cayman attestations.
2022-present: BDO Italia attestations, quarterly. More detailed reserve composition disclosure.
Persistent industry criticism: still not 'full audit' (audit would require auditor independently verify control of assets, cash flows, etc. Tether attestations are 'agreed-upon-procedures' lower-rigor).
USDT operational scale em 2026
Despite ongoing skepticism, USDT continued growing. Em maio 2026, USDT market cap is ~$130 billion (largest stablecoin). USDT operations span Ethereum, Tron, Solana, Avalanche, Polygon, Arbitrum, Optimism, e others.
Tether is one of most profitable companies em world (per employee). Em 2024-2025, generated estimated $5-8 billion em annual profits from reserve yield (US T-bills yielding 4-5%). Significantly more profitable than traditional banks per dollar.
Lições e implicações
Lição 1: market acceptance of imperfect stablecoin can persist despite known issues. USDT continues to dominate volume despite history of opacity. Many users prioritize liquidity over perfect transparency.
Lição 2: regulators have leverage but not always conclusive. NYAG case resulted em $18,5M settlement (tiny relative to Tether's value). DOJ criminal pursuit appears stalled or resolved confidentially.
Lição 3: market structure encourages stablecoin concentration. USDT's first-mover advantage e network effects (exchanges, P2P platforms default to USDT) create persistent moat.
Para o usuário: USDC remains preferable for compliance-conscious uses. USDT preferable for liquidity-priority uses (emerging market corridors, P2P). Diversification entre USDC e USDT é sensible for significant stablecoin holdings.
Aviso YMYL: stablecoins not insured deposits. Issuer failure can result em loss. Reserve composition matters — bias toward US T-bill backing (USDC, increasingly USDT) é most conservative. Avoid algorithmic stablecoins (failed em 2022, no successful new generation since).
